Earlier this month, Justin Barrett Frazell, a former country radio station
host in North Texas, pleaded no contest to a Denton County indecent assault charge.
According to the Fort Worth Star-Telegram, Frazell had sex crimes convictions
on his record prior to adding indecent assault to his list of offenses. Frazell was charged with indecent assault in December 2020 while at the
Lucky Spur Ranch Retreat in Justin, Texas.
Frazell was at the Lucky Spur hosting an event. A woman who was attending
the event told law enforcement that after the event was over, she and
her date went back to their room. While they were asleep in the bedroom,
Frazell came in and began fondling the woman. Reportedly, he was only
wearing a T-shirt and underwear at the time. Frazell left the bedroom
after the woman began to wake her date. The report doesn’t specify
whether Frazell was staying in the same room at the Lucky Spur or if he
had entered their room uninvited.
Reportedly, following his plea, Frazell was sentenced to 18 months of deferred-adjudication
probation and 80 hours of community service.
What Are Examples of Indecent Assault in Texas?
In Texas, any form of groping or inappropriate sexual contact is considered
indecent assault. However, there are more clear-cut illustrations of indecent
assault than that. The following are examples of what specific acts are
considered indecent assault in Texas:
- Touching any part of another person’s genitals, breasts, or anus
- Causing a person to contact the feces, semen, vaginal fluid, blood, or
urine of another person
- Touching a person with any part of another person’s anus, genitals,
or breasts
- Attempting to expose or exposing any part of another person’s pubic
area, buttocks, genitals, nipples (female only), or anus
What Are the Penalties for Indecent Assault in Texas?
Indecent assault is categorized as a misdemeanor in Texas. Still, punishments
for an indecent assault conviction are often more severe than people realize.
The penalties for an indecent assault conviction in Texas includes the
following:
- Up to a year in county jail
- Up to $4,000 in fines
In addition, even though indecent assault is sexual in nature, unlike many other
sex crimes, people convicted of indecent assault are not required to register as
sex offenders.
